Welcome to Click Pix Photobooth! These Terms of Service govern your access to and use of our website, services, and equipment. By using our services or accessing our website, you agree to the following terms and conditions. If you do not agree, please refrain from using our services.

Click Pix Photobooth provides photobooth services for events including but not limited to weddings, corporate events, birthdays, and parties.

By booking our services, you confirm that you are at least 18 years of age or have obtained parental or guardian consent if you are a minor.

All services are subject to availability and may require adherence to additional terms as outlined in our Booking Policy.
2. Booking Policy
Our Booking Policy forms an integral part of these Terms of Service. Please refer to the full Booking Policy above for details regarding booking confirmation, deposit, payment, cancellation, rescheduling, event requirements, damage, and liability.
By booking our services, you agree to abide by all terms outlined in the Booking Policy.
3. Use of Services

Compliance with Venue Rules: The client is responsible for ensuring that the venue allows photobooth equipment and that sufficient space, power, and other requirements are provided as outlined in the Booking Policy.

Responsible Use: Guests are expected to use the photobooth equipment responsibly. Damage caused to equipment due to reckless behavior, spills, or intentional misuse will result in additional fees for repair or replacement.

Operation by Click Pix Staff: Only Click Pix Photobooth personnel are authorized to operate the photobooth equipment during the event.
4. Intellectual Property

Ownership of Photos and Videos: Clients and guests retain ownership of photos and videos taken during the event. However, by using our services, you grant Click Pix Photobooth the right to use these photos and videos for promotional purposes, unless you provide a written request to restrict usage prior to the event.

Website Content: All content on the Click Pix Photobooth website, including text, images, and graphics, is protected by copyright and may not be used, reproduced, or distributed without prior written permission.
5. Privacy Policy
Our Privacy Policy governs how we collect, use, and protect your personal information. Please review it to understand our practices regarding your data. By using our services, you agree to the terms outlined in the Privacy Policy.
6. Payment Terms

All payments must be made as outlined in the Booking Policy.

Payments for services are non-refundable except as specified in the Cancellation Policy.

Failure to make payments on time may result in the cancellation of your booking and forfeiture of any deposits paid.
7. Liability and Indemnification

Limited Liability: Click Pix Photobooth is not responsible for:

Loss, theft, or damage to personal property during the event.

Injury or harm resulting from guest behavior or misuse of the photobooth equipment.

Delays or interruptions caused by events outside of our control, including power outages, venue restrictions, or technical malfunctions.

Indemnification: The client agrees to indemnify and hold Click Pix Photobooth harmless from any claims, damages, or liabilities arising from guest behavior, venue restrictions, or misuse of equipment.
8. Force Majeure
We are not responsible for cancellations, delays, or non-performance due to circumstances beyond our control, including but not limited to natural disasters, pandemics, government restrictions, or power outages. In such cases, we will work with you to reschedule your event or issue a partial refund, as outlined in our Booking Policy.
9. Termination of Services
Click Pix Photobooth reserves the right to terminate services immediately if:

Guests or the client engage in inappropriate, illegal, or unsafe behavior that puts our staff or equipment at risk.

The venue fails to meet the agreed-upon requirements for space, power, or access.
No refunds will be issued in the event of termination caused by the client or guest actions.
10. Dispute Resolution

Good Faith Efforts: In the event of a dispute, both parties agree to resolve the matter in good faith before pursuing legal action.

Jurisdiction: These Terms of Service are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in courts located in Toronto, Ontario.
11. Updates to Terms of Service
We may update these Terms of Service periodically to reflect changes in our practices, services, or legal obligations. Any updates will be posted on our website with the "Last Updated" date. Continued use of our services constitutes acceptance of the updated terms.
